Are California paycheck wage reductions legal or illegal?


Something you may have heard is that as a worker, your supervisor has the right to deduct from your wages. What you didn't know is that there are just few reasons why they can legitimately make a reasoning of wages from your paycheck. 







When can my supervisor deduct from my paycheck compensation? 


  • When obliged to do so by state or government law 
  • When induction is expressly endorsed in making by the employee to cover insurance premiums, benefit plan responsibilities or distinctive thinking not signifying a discount on the laborer's wages. 
  • When a deduction to cover prosperity, welfare, or annuity duties is unequivocally sanction by a payment aggregate dealing understanding.

Know your Rights!

There are typical payroll conclusions often made by chiefs that are unlawful: 


Work Code 351 | Gratuities. A chief can't accumulate, take, or get any tip or part thereof given or left for a specialist, or deduct any aggregate from wages as a result of an agent by uprightness of a tip given or left for a laborer. Keep in mind that a restaurant may have a game plan considering tip pooling/bestowing among laborers who give immediate table administration to buyers. 

Work Code 401 | Photographs. If an official wishes to have or obliges a photograph of an agent or competitor, the business must pay the total cost of the photograph. 

Work Code 401 | Bonds. If a supervisor wishes to have or obliges a bond for a delegate or applicant, the superintendent must pay the total cost of the Bond. 

Work Code 2802 | Uniforms. If the supervisor obliges that a delegate wear an uniform, the business must pay the total cost of the uniform. Keep in mind that the term uniform consolidates wearing clothing and additional items of distinctive blueprints and shades according to organization necessities, see Industrial Welfare Commission Orders, Section 9. 

Work Code 2802 | Business Expenses. Let's assume you realize expenses or mishaps in the quick consequence of the arrival of your work commitments, you are qualified to be compensated and it is the organizations commitment to reimburse you for those monetary benefits. 

Work Code 222.5 | Medical or Physical Examinations.
